1. Acceptance of Terms

By engaging the services of The Don Private Security Solutions (Pty) Ltd ("the Company", "we", "us"), or by using this website, you ("the Client") agree to be bound by these Terms of Service. If you do not agree, please refrain from using our services or website.

2. Company Registration & Regulatory Compliance

The Don Private Security Solutions (Pty) Ltd is registered in South Africa (Reg No: 2026/062968/07) and operates in compliance with the Private Security Industry Regulation Act (PSIRA) 56 of 2001. All security officers deployed by the Company are PSIRA-registered and hold valid certificates of registration. Proof of registration is available upon request.

3. Services Provided

The Company provides the following security services, subject to a formal written agreement:

The specific scope, duration, and pricing of services are governed by the signed Service Level Agreement (SLA) between the Company and the Client.

4. Service Level Agreement

All ongoing security services require a formal SLA which will specify: scope of work, deployment schedules, response times, escalation procedures, performance metrics, and payment terms. The SLA constitutes the binding agreement between parties and supersedes any verbal representations.

Unless otherwise stated in the SLA, invoices are due within 30 days of issue. Late payments attract interest at the prime lending rate plus 2% per annum, compounded monthly. The Company reserves the right to suspend services upon material breach of payment obligations following written notice.

7. Liability & Indemnity

The Company's liability is limited to direct losses arising directly from our gross negligence or wilful misconduct. We shall not be liable for:

8. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and sensitive information disclosed in connection with the services, including security plans, site assessments, patrol schedules, and client business information. This obligation survives termination of the service agreement.

9. Intellectual Property

All security plans, risk assessments, procedures, and documentation produced by the Company remain the intellectual property of The Don Private Security Solutions (Pty) Ltd unless expressly transferred in writing. The Client receives a limited licence to use such documents solely for the purposes of the agreed services.

10. Termination

Either party may terminate a service agreement by providing written notice as specified in the SLA (typically 30 days). The Company may terminate with immediate effect in the event of: non-payment, a material breach by the Client, conditions rendering the site unsafe for personnel, or conduct creating legal liability for the Company.

11. Use of This Website

This website is provided for informational purposes. You may not use it to: distribute malware, conduct fraudulent activities, scrape data without consent, or impersonate the Company. We reserve the right to block access to any user who violates these conditions.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the Gauteng High Court, Pretoria. The parties agree to attempt good-faith mediation before initiating formal legal proceedings.

13. Amendments

The Company reserves the right to update these Terms at any time. Material changes will be communicated to active clients via email or written notice. Continued use of services after such notification constitutes acceptance of the revised Terms.
